LEXLION - TERMS OF SALE

These Terms of Sale (hereinafter referred to as the "Terms") govern the sale of products through the website https://thelexlion.com (hereinafter the "Site"), operated by LEXLION.

1. General Provisions

By placing an order on the Site, the customer (hereinafter the "Customer") acknowledges having read, understood, and accepted these Terms without reservation. These Terms are accessible at all times on the Site and may be modified by LEXLION without prior notice.

The applicable Terms are those in effect on the date the order is placed.

2. Products

LEXLION offers a range of insulated water bottles, thermoses, and related accessories (hereinafter the "Products"). Each Product is presented with a detailed description. Images are for illustrative purposes only and are non-contractual.

The Customer is responsible for ensuring the compatibility of the Products with their intended use.

3. Orders

Orders are placed directly on the Site. To place an order, the Customer must:

  1. Select Products and add them to the cart.
  2. Review the cart and confirm the order.
  3. Accept these Terms.
  4. Complete payment securely.

An order confirmation will be sent via email. LEXLION reserves the right to cancel or refuse any order for legitimate reasons, such as suspected fraud or stock unavailability.

4. Prices and Payment

  • Prices: All prices are listed in USD ($) and include applicable taxes unless stated otherwise. Shipping fees are calculated at checkout.
  • Payment Methods: Secure payments are accepted via credit/debit cards, PayPal, and other options displayed at checkout.
  • Payment Security: LEXLION uses secure payment gateways to protect transaction data.

5. Shipping and Delivery

  • Delivery Areas: We primarily ship to the United States, with limited international shipping available to selected countries in Europe.
  • Shipping Times: Orders are processed within 1-3 business days. Delivery times vary based on location.
  • Shipping Costs: Displayed during checkout.
  • Responsibility: LEXLION is not responsible for delays caused by third-party carriers or customs procedures.

If a Product is unavailable after the order is placed, LEXLION will notify the Customer promptly, offering a refund or an alternative.

6. Returns and Refunds

Please refer to our detailed Return & Refund Policy for information on:

  • Conditions for returns (30-day return window).
  • Refund eligibility (damaged items, incorrect products, etc.).
  • Return shipping responsibilities.

7. Right of Withdrawal (EU Customers Only)

In accordance with EU regulations, EU-based Customers have the right to withdraw from the purchase within 14 days of receiving the Product, without providing a reason. Exceptions apply for personalized items.

8. Legal Warranties

Who’s covered: The original purchaser who bought directly from thelexlion.com or our official Amazon store.

What’s covered

LEXLION warrants that its drinkware and accessories (tumblers, bottles, lids, straws, infusers) are free from manufacturing defects in materials and workmanship under normal household use for 12 months from the delivery date.

Our sole obligation—and your exclusive remedy—is, at our option, to repair, replace, or refund the defective item (refund not to exceed the price paid).

What’s not covered

This warranty doesn’t cover:

  • Normal wear and tear (scratches, dents, dings, scuffs, cosmetic discoloration/fading, logos rubbing off).

  • Damage from misuse, drops/impacts, modifications, improper cleaning (e.g., bleach/chlorine), or commercial use.

  • Heat/cold performance loss caused by damage or long‑term wear.

  • Lost or consumable parts (straws, gaskets, silicone boots) after 30 days.

  • Any item purchased from unauthorized sellers or second‑hand.

  • Minor cosmetic variations or color differences between batches/photos.

How to make a claim

Email contact@thelexlion.com with:

  1. Order number and place of purchase

  2. Product name/color/size

  3. Description of the issue + clear photos/video
    We’ll reply with next steps. If a return is required, we’ll provide instructions. For approved claims, we cover return or reship postage.

Proof of purchase

A valid receipt/order confirmation is required. Warranty is non‑transferable.

Duration & legal terms (US)

This is a Limited Warranty under the Magnuson‑Moss Warranty Act. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL IMPLIED WARRANTIES ARE LIMITED TO 12 MONTHS. LEXLION SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. Some states don’t allow limits on implied warranties or exclusion of incidental/consequential damages—if so, these limits may not apply to you. This warranty gives you specific legal rights; you may have other rights which vary by state.

EU/UK customers (legal guarantee)

If you are a consumer in the EU/UK, you benefit from the statutory legal guarantee of conformity with the seller (typically 2 years from delivery, local rules may vary). This legal guarantee exists in addition to this commercial warranty and applies according to your local law.

9. Limitation of Liability

LEXLION shall not be liable for:

  • Damages caused by improper use of the Products.
  • Delays or failures due to force majeure (natural disasters, strikes, etc.).
  • Indirect damages such as loss of profits or data.

Our liability is limited to the purchase price of the Product in question.

10. Intellectual Property

All content on the Site (texts, images, logos, etc.) is the exclusive property of LEXLION. Any unauthorized use may result in legal action.

12. Governing Law and Dispute Resolution

  • Governing Law: For U.S. Customers, these Terms are governed by the laws of the State of Delaware. For EU Customers, French law applies.
  • Dispute Resolution: In case of a dispute, Customers may contact a consumer mediator or use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

For U.S. Customers, disputes will be resolved through binding arbitration, as per the Federal Arbitration Act, unless otherwise required by law.

By placing an order, the Customer confirms having read and accepted these Terms of Sale. The Terms applicable are those in effect at the time of the order.
